Nagsampa ng mga kasong plunder at korapsiyon sa Office of the Ombudsman laban sa mga senior official ng Philippine Charity Sweepstakes Office (PCSO) at sa mga director ng pribadong kompanya na sangkot sa e-lotto operation.
Base sa ulat ng Abogado.com.ph, kinasuhan ang paglabag sa Section 3(e) at (g) ng Anti-Graft and Corrupt Practices Act at Section 2 ng Plunder Law ang mga opisyal ng PCSO at pribadong kompanya.
Base sa isinampang reklamo ng Filipinos for Peace, Justice and Progress Movement Inc. (FPJPM), nakasaad sa memorandum of agreement ng PCSO na bibigyan ang Pacific Online Systems Corp. (POSC) ng 14% commission bagama’t ang proposal ng pribadong kompanya ay zero commission o walang gagastusin ang gobyerno.
Nakasaad pa sa reklamo na base sa mga isinumiteng dokumento, malinaw umano na ang web application system, payment gateway, telecommunication cost, service level agreement premium support, cloud service subscription, maintenance cost, at service hosting cost ay inalok ng kompanya na walang gastos sa panig ng PCSO.
Binigyang-diin sa reklamo ng FPJPM na pinirmahan umano ni PCSO General Manager Melquiades A. Robles ang MOA na nagsasaad ng 14% commission kung kaya’t mayroon umanong criminal intent para dayain ang gobyerno.
“The Letter of Intent and accompanying documents clearly stated ‘at no cost’ to the government. Nag-contract negotiations lang sila ay biglang napatungan na ng 14% commission. Eh ‘zero commission’ nga as per original proposal. We need the PCSO general manager to answer the question: Anyare?” ayon kay FPJPM spokesman Edwin Valenzuela.
Binanggit pa sa reklamo na inaprubahan ng PCSO ang minimum jackpot prizes ng e-lotto nang hindi alinsunod sa mga rekomendasyon ng Office of the Government Corporate Counsel (OGCC). na dapat certification mula sa industry body at mayroong actuarial study.
Nilarga umano ang experimental run ng e-lotto noong Disyembre 2023 kasabay ng pagtaas sa minimum lotto games prizes sa P500 per million sa kabila ng advisory mula sa OGCC laban dito.
Hinugot umano ang karagdagang P1.7 bilyong jackpot prize sa limang experimental e-lotto games mula sa price fund reserve ng PCSO.
Kabilang sa mga kinasuhan ay sina Robles, PCSO general manager at board chairman Felix P. Reyes, at ang mga opisyal ng POSC sa pangunguna ng chairman na si Willy N. Ocier at president Jackson T. Ongsip.
Kasama rin sa mga kinasuhan ang board of directors ng PCSO na sina Jennifer E. Liongson-Guevara at Janet De Leon Mercado gayundin ang mga board member ng POSC na sina Raul B. De Mesa, Tarcisio M. Medalla, Henry R. Ocier and Armin B. Santos.
Samantala, nagbigay naman ng kanyang pahayag si Robles ukol sa isinampang reklamo ng FPJMP sa Ombudsman.
“It is unfortunate that the FPJPM filed a complaint without understanding the MOA PCSO entered with a service provider. Our agreement is not final until we get a favorable decision from OGCC. All issues cited are now overtaken by events as the OGCC has already given PCSO a favorable review on the contract we entered into. This is gross misrepresentation of facts which we suspect was made by the former chairman who surprisingly was not included in the complaint,” ayon sa pahayag ni Robles.
